Reasons
- The applicant attended the hearing by phone. The respondent did not answer on four attempts to contact him on the numbers provided.
- The landlord has applied for termination of the tenancy and payment of rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The applicant has told me that they have had conversations with the respondent and believe he has taken some steps to remedy the breach but has not been able to do so fully due to a lack of means. The applicant tells me they would like to give the respondent a rent credit of $1942.00 as a gesture of goodwill and as recognition of these circumstances.
- The landlord provided rent records which prove the amount owing to Tuesday 1 July 2025. I have applied a further weeks rent to reflect the amount owing to the date of termination.
