Both parties attended the hearing.

It is not in dispute that the applicant rented a room in the respondents’ house from 3/12/2024 and agreed to pay weekly rent of $280 and one weeks rent as bond.

When there was a “personality clash” the applicant gave 4 weeks’ notice that she was leaving. She left earlier than this (because she believes the respondent made it untenable to continue living there) for the final week. She wants one week’s rent and the bond refunded. The respondent does not consider she is required to refund any money.

Section 5 (n) of the RTA states that the Tribunal does not have jurisdiction (legal authority) to resolve issues that arise where the landlord continues to live at the premises as their principal place of residence, (and the premises are not a boarding house, which they are not as the applicant is the only boarder or flatmate residing there, when a “boarding house” requires an intention to have at least 6 boarders.

For completeness, I note also that the parties have no written agreement so did not agree in writing or otherwise to contract back into some or all of the provisions of the RTA

While I indicated a willingness to assist the parties resolve the issue by consent, it was quickly apparent that the issue requires adjudication as an agreed order was most unlikely.

It is the Disputes Tribunal that has jurisdiction to consider the issues raised and make the binding order required. The applicant said that she will lodge the claim in that Tribunal.

As the Tribunal does not have jurisdiction to consider the issues raised (and it was reasonable to lodge the claim and have the Tribunal consider the jurisdiction issue) there is no public interest in publishing both parties names. Name suppression is therefore approved for both parties.
