The landlord applied to the Tribunal for termination of the tenancy for breach of the tenant’s obligations and a hearing was held on 10 June 2025. Mr Maihi did not attend that hearing and an Order terminating the tenancy and ordering rent arrears and reimbursement of the filing fee was made on that day – a total of $1,289.96.

The amount owing came from the bond with the remaining amount of bond to stay at the Bond centre until a further Order by the Tribunal or agreement between the parties.

On 11 June 2025 Mr Maihi applied for a rehearing on the grounds that he did not receive proper notification of the hearing because the email sent by the Tribunal went to his daughter’s email address and into spam.

Section 105(1) Residential Tenancies Act 1986 provides that the Tribunal has the power to order a rehearing where “a substantial wrong or miscarriage of justice has or may have occurred or is likely to occur”.

Usually the party applying for the rehearing must show that something went wrong with the Tribunal’s procedure, for example, that they did not receive notice of the hearing or they were not able to properly present their case. A rehearing may also be granted where there is new evidence that was not reasonably available at the first hearing, if it could have affected the outcome.

Has a substantial wrong or miscarriage of justice occurred?

I do not accept that a substantial wrong or miscarriage of justice has occurred in this case. While I accept that the Notice of Hearing may have gone into Mr Maihi’s daughter’s spam account, she advised the Tribunal at today’s hearing that she opened it two days before the scheduled hearing.

If it was considered that that was not adequate notice at the time, then an adjournment may have been requested, either at the hearing or before the hearing.

In any event I consider that Mr Maihi’s daughter, who was nominated by him as his representative by giving her email address as the email to which communications should be addressed and her telephone number as the number on which he could be contacted, had sufficient time to advise her father of the upcoming hearing and therefore sufficient notice was given.
