Reasons

Both parties attended the hearing which was held by teleconference.
The tenant rented the premises from 18 November 2021 to 29 January 2025. At the end of the tenancy the bond of $2320.00 was released in full to the tenant.
Two and a half months later the landlord, having never previously charged the tenant for water, invoiced the tenant for water charges for the period 10/7/24 to 16/1/25. These water charges amounted to $835.72.
The tenant has not paid these water charges and the landlord now makes a claim in the Tribunal seeking the $835.72 and reimbursement of the filing fee.
I am dismissing the landlord’s claim for two reasons.
Firstly, while I accept that the tenancy agreement provides that the tenant is responsible for paying the water charges, having not charged the tenant for more than three years indicates that she in fact was not required to pay for water. By conduct, the landlord had varied the agreement.
Second, the water invoice shows that consumption for the period 10/7/24 to 16/1/25 has increased significantly. Consumption has risen by almost three times more than the next highest consumption period. This indicates that there is a leak at the property and a tenant ought not to be required to pay these charges.
I am also dismissing the application for reimbursement of the filing fee because the landlord was not successful with their claim.
I am allowing the tenant’s application for suppression of her name – see s95A(3) of the Residential Tenancies Act 1986. C ter Haar 24 July 2025
