Reasons

Both parties attended the hearing via video conference.
The tenancy was from 10 February 2024 until 8 February 2025.
At the end of the tenancy, the landlord applied for compensation for a rip in the vinyl flooring underneath the fridge.
For damage claims, the landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
The tenants had purchased the fridge from the previous tenant. The landlord had photos of the vinyl flooring before the previous tenancy began but did not have any photos to prove the state of the vinyl flooring at the beginning of this tenancy from February 2024.
The tenants claimed that the vinyl flooring was already ripped when their tenancy began.
Both parties provided photos to prove the state of the vinyl flooring at the beginning of the premises.
As the landlord is the applicant, the landlord must establish the claim to the civil law standard of proof, on the balance of probabilities.
In this case, the landlord has not satisfied me that it was more likely than not that the vinyl flooring was not damaged at the beginning of the tenancy.
Therefore, this claim is dismissed.
The bond is to be refunded to the tenants in full.
