On 8 May 2025 the landlord applied to the Tribunal for compensation from the tenant for work carried out at the property after the tenant abandoned the property.

The case was heard by me on 11 July. The landlord produced an invoice for tree trimming, weed spraying work and lawn mowing. The invoice was not itemized to show the cost of various work at the property. Tenants are not responsible for tree trimming or weed spraying. Tenants are usually responsible for gardens and lawn mowing. To give the landlord opportunity to provide better evidence I adjourned the hearing and ordered that: At least 6 days prior to the next hearing, the landlord will email to the tenant and the Tribunal, an itemized invoice of the work carried out by the contractor on the lawns and gardens at the property at the end of the tenancy.

The landlord has not provided that evidence to the Tribunal or the tenant as required by my order dated 11 July 2025.

At the hearing on 11 July there were no photos provided to the Tribunal to show the condition of the property at the end of the tenancy or rubbish that the tenant left at the property. To give the landlord opportunity to provide better evidence I adjourned the hearing and ordered that: At least 6 days prior to the next hearing, the landlord will email photos of rubbish left at the property and photos of overgrown lawns, gardens when the tenancy ended. Photos are to be emailed to both the Tribunal and the tenant.

The landlord has not provided that evidence to the Tribunal or the tenant as required by my order dated 11 July 2025.

Tribunal time is valuable. It is not reasonable to adjourn and give the landlord a third opportunity to provide basic evidence in support of the claim.

The failure by the landlord to provide necessary evidence for the Tribunal to make a safe decision must result in the claim being dismissed. Suppression

The landlord has applied for name suppression. Section 95A(1) of the Residential Tenancies Act 1986 provides that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.

The landlord has not substantially succeeded with the claim and therefore name suppression is not granted. Filing fee

Because the landlord has not been successful with the claim the filing fee is not ordered to be paid by the tenant.
