The landlord attended the hearing, set down to be conducted via video. Two calls to the tenants number went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for rent arrears, water rates, compensation, and reimbursement of the filing fee following the end of the tenancy. The bond has already been released to the landlord.
The landlord advised the agent (absent today) has been in touch with the tenants recently and believed there was verbal agreement between them regarding the claims. No written evidence of this was available.

The tenancy has ended via a 21-day notice to terminate from the tenants on 6 July 2025. This was a fixed-term tenancy that defaulted to a periodic tenancy. The tenants have already moved out, but the premises remains vacant. The landlord sought rent arrears to the end date of 26 July 2025. The landlord provided rent records and water rates invoices which prove the amounts owing at the end of the tenancy.
Given the current vacant state and proximity to the end of rent liability I have dealt with the full rent arrears in this order. The landlord is advertising but as yet there is nor prospective new tenants. If the premises is relet before 26 July 2025 the rent arrears will rebate accordingly.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claims the tenants did not leave the premises reasonably clean and tidy, and did not remove all rubbish. Further, it claimed the lawns needed mowing. Comparative photos from entry were viewed.
In support of the claims the landlord provided invoices of $805.00 for cleaning (including carpet cleaning), $399.00 for rubbish removal, and $80.00 for the lawn mowing. Photographic evidence for each claim was provided and established the need for the effort and subsequent costs as incurred. The three invoices are awarded in full.
The amounts ordered are proved.

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The landlord claimed $92.00 for the reattaching of the laundry door handles. As shown in photos, they had come off and were left on a nearby windowsill. We reviewed the routine and exit inspection reports during the hearing, but they provide no further insight into the probable cause. The landlord has not been able to establish the repair was required for anything more than normal wear and tear and that claim is dismissed. Filing fee
