New Zealand Tenancy Tribunal Case 5276699 — Rent arrears

Reasons

[Property Managers], Property Managers, appeared for the landlord. The tenant appeared.

The tenancy commenced on 6 December 2024 with the fixed term due to expire on 11 January 2026.

On 30 May 2025 the landlord filed an application with the Tribunal seeking termination of the tenancy for breach of the tenant’s obligations, rent arrears, refund of the bond and reimbursement of the filing fee.

At the commencement of the hearing the landlord withdrew their application for immediate termination of the tenancy, rent arrears and refund of the bond.

On 4 July 2025 the tenant paid the landlord $3850.00, clearing the rent arrears and placing the rent into credit.

Despite withdrawing the application for termination of the tenancy the landlord proceeded to make an application for a conditional termination order.

Under section 56(1) of the Residential Tenancies Act 1986, the Tribunal may terminate a tenancy for a breach, where, due to the nature and extent of the breach it would be inequitable to refuse termination.

Under section 78(k) of the Act, the Tribunal can order a tenant to pay a landlord any sum found to be owing, whether by way of rent arrears or otherwise pursuant to the tenancy agreement.

The landlord issued a 14-day breach notice on 20 May 2025, advising the tenant they were $550.00 in rent arrears.

The notice was remedied on 20 May 2025.

The Tribunal acknowledges that the up-to-date rent records show the tenant failed to pay rent between 23 May 2025 and 3 July 2025. But these records also show that on 4 July 2025 the tenant paid the landlord $3850.00. This payment cleared the arrears and put the tenant in rent credit, which endures at the date of hearing.

There are no grounds to terminate the tenancy and no ability for the Tribunal to make a conditional termination order.

The Tribunal reminded the tenant of their ongoing obligations to pay rent in accordance with their tenancy agreement and the Act. The tenant explained they had fallen into rent arrears after their benefit was cut. The tenant said they had arranged for Work and Income New Zealand (WINZ) to clear the arrears and will tomorrow (Tuesday 8 July 2025) be attending a meeting to have their benefit redirected to their rent account.

The landlord sought an order from the Tribunal requiring confirmation from the tenant of the benefit redirection. There is no legislative mechanism that allows the Tribunal to make such an order. The tenant did undertake to inform the landlord of the outcome of their meeting with WINZ, which the Tribunal encourages the tenant follow through with, to avoid any further applications being made. Costs

The landlord has not succeeded with their application, I therefore do not make any order for payment of the application fee. Name Suppression

Under section 95A of the Act a party who has been either wholly or substantially successful is entitled to name suppression unless the Tribunal finds that there are reasons relating to the conduct of the party not to do so. In this case the landlord responsibly withdrew their substantive claims and is granted name suppression.

The tenant has been wholly successful and is granted name suppression.
