Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the parties’ names and identifying details.
- The tenant will vacate the premises and remove his belongings from the premises today. Apart from obligations owed under this Order, the tenant is now released from any obligations owed to the landlord under the tenancy agreement between the parties dated 31 October 2024.
- The Bond Centre is to pay $1,260.00 from the bond of $2,520.00 ([Bond number suppressed]) to [The applicant/s] immediately.

Reasons
- Both parties attended the hearing which was held by teleconference.
- The tenant is one of two joint tenants under this tenancy, which is for a fixed term from 6 November 2024 to 5 November 2025
- The landlord says that the tenant assaulted his co-tenant and has applied for orders: a. ending the tenant’s tenancy; b. requiring that he pay his share of rent arrears owed; and c. releasing the tenant’s share of the bond against those rent arrears.
- I make no findings in respect of that allegation.
- I have explained to the parties that because the tenant and his co-tenant are tenants jointly, there are no separate shares of the rend or bond that can be separately considered. The Tribunal could not Order termination of the tenancy of just one of two joint tenants, termination of the tenancy itself would be required. Or, the co-tenant could apply to have the joint tenancy vested in her under the Family Violence Act 2018 (s.121).
- The parties confirm that with that knowledge, they agree to the outcome Ordered. That seems a sensible resolution of the situation which I am comfortable endorsing through a consent Order.
- I note for the record that arrangements have been agreed between the parties for the tenant to collect his belongings, with movers coming this afternoon.
- As this Order simply records an agreement between the parties, no order is made in respect of the filing fee.
- Given the sensitivities of the situation, it is appropriate that all parties identifying details be suppressed.
