- The application is dismissed.
Reasons
- This application was scheduled to be heard by teleconference.
- I rang the applicant three times at the scheduled hearing time and all three calls went to voicemail. I left messages advising that I would call back in a couple of minutes but was unsuccessful in contacting the applicant.
- The applicant had not requested an adjournment, and nor did he notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
- The application is therefore dismissed.
- I note that the tenant attended the hearing by answering her phone.
- During my conversation with her I ascertained her current email address and advised that it would be used as her address for service.
- I also note that there is a Tribunal Order dated 24 February 2025 which gives possession of the premises to the landlord. The application numbers for this hearing were 5150572 and 5078448. The tenant did not attend that hearing and the order was made in her absence. C ter Haar 27 August 2025
