Tenancy Tribunal case 5280070 — Rent arrears at 2 Upper Buller Gorge Road, Inangahua, Reefton 7895
Decided 24 Sept 2025 · Published 24 Sept 2025 · Application 5280070
- Rent arrears
Order
- [The tenant/s] tenant/s] must pay [The tenant/s] landlord/s]/O Colliers New Zealand Ltd $1,709.80 immediately, calculated as shown in table below.
- The Bond Centre is to pay the bond of $800.00 (6333449-001) to [The tenant/s] landlord/s]/O Colliers New Zealand Ltd immediately.
Reasons
- The landlord attended the hearing on 18 September 2025 via teleconference. The tenant did not.
- The tenancy was from 23 March 2020 until 29 January 2023.
- On 5 June 2025, the landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee.
- At the hearing, the landlord did not have evidence on hand of the tenant’s email address having been used within the 2 years before the application.
- After the teleconference had ended, the landlord emailed through evidence of the tenant having used her email address on 14 May 2025. Therefore, I am satisfied that the application had correctly been served on the tenant according to section 91A of the Residential Tenancies Act 1986 and make this order.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- I order the tenant to pay the landlord $2,482.80 for rent arrears to 29 January 2023.
- Further to this, as the landlord has wholly succeeded with the claim, the tenant must reimburse the filing fee.
- The bond of $800.00 held at the Bond Centre will be released to the landlord to offset the amount payable by the tenant.
