The parties were made aware of the hearing date again just prior to the hearing, as I made a direction on 20 August 2025 as follows: The landlord requested an adjournment of the tenant’s application or to attend the tenant’s application hearing by phone, both requests of which were declined. The landlord’s recently filed cross application was then scheduled to be heard on the same day as the tenant’s application, which is Thursday 21 August 2025. The landlord has again requested that the hearing be adjourned as she is in Auckland until late September. I direct that the tenant’s application will proceed to be heard face-to-face in Gisborne for the day on Thursday 21 August 2025, as scheduled. However, given the landlord’s cross-application has only recently been filed and served, I grant the landlord’s request to adjourn her own cross-application hearing. Therefore, the landlord’s cross- application will be rescheduled and will be heard as a face-to-face hearing later, at a date to be advised by Tenancy Services, but the tenant’s application will proceed to be hearing on Thursday 21 August 2025, as scheduled.

Further, immediately prior to the hearing on Thursday 21 August 2025, the Registrar emailed the tenant asking him to bring the video evidence with him to the hearing as his dropbox link in the application documents could not be accessed.

The Registrar sought out the parties and called the parties’ names for the hearing, four times after the hearing start time at 9:30am, waiting until 10am on Thursday 21 August 2025, still with no parties in attendance or any emails from the tenant about why he was not attending the hearing.

The applicant did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.

The other party did not attend the hearing either.

As such, the tenant’s application is dismissed.
