Reasons

This application was scheduled to be heard by teleconference. The tenant answered my call but hung up once she became aware that this was a hearing. My next call to her went to voicemail. The hearing proceeded in her absence.
This order ought to be read together with the Tribunal order dated 28 August 2025. The hearing on that day was adjourned to allow the tenant notice of all claims being made against her.
The landlord has applied for rent arrears, compensation, and reimbursement of filing fees following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 3 May 2025. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
The rent record shows that the tenant owes $1400.00 in rent. This amount is inclusive of the bond being paid towards the arrears.
The tenant has been paying off the water accounts but has stopped making any payments. The amount outstanding in water remains at $316.41.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claims $207.00 as the invoiced cost of having the carpet cleaned when the tenant had vacated. However I have reduced the amount claimed to $80.00 because the evidence provided in the form of photographs shows that by and large the carpet was left reasonably clean, except for in one of the bedrooms and part of the garage.
The photographs show that the lawn was not left in a reasonable state and so I am satisfied that the tenant ought to pay the invoiced cost of $103.05 to have this remedied.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The photographs show that the walls in the garage, the hallway, the staircase and in a bathroom were damaged. The photographs also show that there were dents in the garage door.
The damage repaired was beyond fair wear and tear and the tenant has not disproved liability for it.
The amount ordered to remedy these issues was proved with an invoice.
The tenant also broke a window during her tenancy and had been making payments towards the cost of repair of this window. The amount remaining to be paid is $123.00. Filing fee reimbursements
I accept that the tenant has not paid the filing fee for the mediation that occurred on 3 October 2024 for application 4986268. I am therefore ordering her to pay it today.
I am also ordering her to reimburse the filing fee to the landlord for this application because the landlord was substantially successful with this claim against her. C ter Haar 15 October 2025
