An application for name suppression has been made in this case. The Tribunal orders suppression of the name and identifying details of the tenant.
The Bond Centre is to release the bond of $2,200.00 ([Bond number suppressed]) to Regent Realty Limited As The Agent For Paul & Julie Rowlands upon receipt of the appropriate documentation, including a copy of this Order, which is to be lodged by the landlord.

Reasons

The landlord attended the hearing. Neither the tenant, nor her agent (noted as her sister and emergency contact on the tenancy agreement), did not attend
After the Tribunal attempted to contact the tenant via her mobile phone – leaving a voicemail about the hearing – the landlord provided the following information: a. The tenant has always been an excellent tenant; b. The tenant is currently unwell and may still be in hospital; c. The tenant’s agent (her sister) served a notice of termination on the tenant’s behalf; d. The property has since been vacated and there are no issues regarding its condition; e. Following discussions between the landlord, the property owner, and the tenant’s agent, it was agreed that the landlord would not seek rent arrears beyond the bond amount and would also waive seeking reimbursement of the Tribunal filing fee; f. The tenant’s agent indicated that she would be available if required for the Tribunal hearing.
Given these circumstances, the Tribunal is satisfied that it is appropriate to proceed in the absence of both the tenant and/or her agent.
The landlord has applied for release of the bond to offset rent arrears and has also requested name suppression given the tenant’s health.
The landlord provided rent records, which confirm the amount owing as at the termination date. It is therefore appropriate that the bond be released to the landlord to offset the arrears. The landlord is responsible for lodging the appropriate Bond Centre forms along with a copy of this Order.
Given the rare and compassionate circumstances presented, the Tribunal grants the landlord’s request for name suppression. I am satisfied that the potential harm from publication outweighs the usual public interest in Tribunal decision transparency.
Finally, the Tribunal acknowledges the tenant’s otherwise impeccable tenancy record, her unfortunate health circumstances, the supportive involvement of her agent, and the respectful and compassionate approach taken by both the landlord and property owners in managing this situation.
