The term of the fixed-term tenancy of [The tenant/s] at Unit/Flat 912, 172 Thorndon Quay, the sebel, Pipitea, Wellington 6011, is reduced and now ends at 11.59 pm, Tuesday, 14 October 2025.
The Bond Centre is to pay the bond of $1,800.00 to THQ Developments Limited Nadene Hunt immediately.
The bond is refunded to THQ Developments Limited, Nadene Hunt, in full and to be used for rent arrears until a new tenancy begins.
The tenancy is terminated on the day a new tenancy begins, or on 11.59pm, Tuesday, 14 October 2025, whichever occurs first.

Reasons

Both parties attended the hearing by telephone conference.
The tenant has applied for reduction of the fixed-term tenancy due to end on 20 June 2026.
The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986.
There has been an unforeseen change in the tenant's circumstances. The tenant is suffering from eczema which is not improving. He has been twice to his doctor once in 2022 and again in 2025 who prescribed him a steroid based cream. The tenant said that that although the first treatment worked the second has not and when he stops using it the condition comes back worse. This has affected every area of his life. Photographs and a copy of what he has been prescribed were provided.
The tenant seeks the reduction of the fixed term so that he can return to his home in India and get treatment for the root of the problem. He has terminated his employment and is to leave on 21 July 2025.
The tenant has tried, with the help of the property manager, to find a replacement tenant and has offered his bond in full to the landlord to cover rent after he leaves,but said that he cannot afford to continue to pay the rent.
The tenant renewed his fixed term tenancy for another year on 28 May 2025 to end on 26 June 2025.He said that then, the skin condition was under control but has since come back a lot worse.
The tenant would suffer severe hardship if the term of the tenancy were not reduced because he would be liable for another 11 months of rent when he was not living there and believes that he will not be able to work while undergoing treatment.
The landlord would suffer hardship if the term were reduced because they believed that they had a 12-month fixed term tenancy and rely on the income to meet their costs.
The landlord said that the residential tenancy market is in a rental slump, and tenants are difficult to find. The property manager estimated that it would take from 6 to 12 weeks to find new tenants and they may have to lower the amount of weekly rent charged.
This is situation is not easy for both parties. The landlord acknowledged the tenant’s problem and has tried to find a replacement tenant with advertising and viewings currently underway.
There is no obligation on a landlord to agree to a reduction of a fixed term, but the landlord has suggested that the term of the tenancy be reduced to 3 months. If a replacement tenant is found within that time period, the tenant is released from the tenancy.
From the date of the hearing there is just over 11 months left on the tenancy which is a substantial amount of time. The balance between the tenants hardship and landlords is difficult, and I find that the offer made by the landlord is the best solution in this instance.
The tenancy will be reduced to terminate in 3 months, being Tuesday 14 October 2025 or earlier if a new tenant is found.
The bond of $1800.00 will be forward to the landlord who will use this, and the one-week rent paid in advance to cover any rent any owing, again if this is required. By my calculations this amounts to a total of $2250.00 equivalent to 5 weeks rent that the landlord will hold in credit for the tenants.
If a new tenant is not found within that period it leaves tenant to be liable to pay rent for a maximum of 7 weeks.
If the landlord finds a replacement tenant within 5 weeks credit period any balance of funds held is to be refunded to the tenant.
