Decided 21 Aug 2025 · Published 21 Aug 2025 · Application 5296614
- Rent arrears
Order
- [The tenant/s] tenant/s] and [The tenant/s] tenant/s] owes ZL Trustee Property Management - As Agent For Teesh Trustee Limited $1,155.22 (“the debt”) being $1,069.18 for rent arrears to 21 August 2025 and $86.04 for water rates.
- [The tenant/s] tenant/s] and [The tenant/s] tenant/s] must pay rent and the debt as follows: a. Payment of $86.04 on 22 August 2025 towards water rates. b. Weekly payments of $820.00, being $740.00 for rent and $80.00 for the rent arrears. c. Payments towards rent arrears will be every Friday, with the first payment on 22/08/2025 and continuing until 28/11/2025.
- Payments will be allocated in the following order: water rates, rent, and rent arrears.
- If the tenant fails to pay water rates, rent and rent arrears within 2 working days of the due dates: a. The tenancy at 11 Earlywood Road, Takanini, Takanini 2110 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- The Bond Centre is to release the bond of $2,800.00 (bond number 6286545- 001) to ZL Trustee Property Management immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, water rates, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- The parties also agree for the unreleased bond of $2,800.00 from a previous Tribunal order under application number 4715649 to go to ZL Trustee Property Management as the new property managers acting for the landlord.
