Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The rent is well over 21 days in arrears. [Tenant 1] and [Tenant 2] explained that they have been in very difficult circumstances and have had difficulty keeping up with rent payments and payments towards previous arrears.

The parties were able to discuss matters as the hearing today. The tenants agreed to pay an additional $50.00 per week towards arrears together with their current rent. Where possible, they will also pay additional amounts so as to clear the debt more quickly. [Trustee 1] was happy to accept payment of $50.00 per week towards the debt on the basis that the rent is also paid on time.

I am satisfied the tenants will pay the debt within the period specified in the order and are unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

The tenants must be mindful of the fact that if they miss any of the scheduled payments by more than two working days the tenancy will terminate. It is therefore essential that they make all payments as ordered. I strongly recommend that they contact their landlord to discuss if there are likely to be any issues. Name suppression
