Reasons
- The landlord attended the hearing conducted by phone. The tenant could not be contacted at the time of the hearing but I am satisfied service of the Notice of Hearing was undertaken.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- In addition, it should be noted that there has been substantial damage to the property including damage to the toilet, shower, vanity, smashed cook top and hole in the walls. It appears that the tenant is no longer residing at the premises as she advised the landlord she had changed her bail address while friends were doing work on the property.
- When the landlord attended the property for what was to be an end of tenancy inspection she found other people at the house. There were dogs on the property and she was viciously assaulted by one of the people at the house, being punched to the ground and rendered unconscious. The police attended the incident.
- It is for these reasons that termination of the tenancy has been made immediate.
- The landlord will make a separate application once they gain possession and are able to ascertain the damages and confirm other claims they wish to make.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
- As the landlord has sought suppression of their name and identifying details and they have been successful in their application suppression is granted.
