Order

[The tenant/s] tenant/s] must pay Precision Property Management Limited As The Agent For Amelia And [The tenant/s] landlord/s] And [The tenant/s] landlord/s] $154.29 immediately, being rent arrears to 19 June 2025.

Reasons

Both parties attended the hearing.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing as at the end of the tenancy.
The tenant disputes liability to pay the rent arrears because the bond has already been returned to her.
However, the fact that bond has since been returned to the tenant ‘by mistake’ on part of the landlord’s agent does not invalidate the landlord’s claim for rent arrears.
The bond is merely a form of security for the tenant’s observance of the tenancy agreement, including the obligation to pay rent up to the last date of the tenancy. The loss of the bond does not wipe out the debt proved.
The debt arising from 2 days’ rent arrears remains payable.
The amount ordered is proved.
The landlord is prepared, in principle to accept the tenant’s repayment suggestion of $50.00 a week. It is hoped that the tenant will commence repayment this week.
I make a monetary order as set out above.
