Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
[The landlord/s] is granted possession of the premises at [Tenancy address suppressed] immediately.
Kim Te Whaiti and Darren Tungatt must pay the filing fee of $28.00 [the landlord] immediately.

Reasons

Both parties attended the hearing which was conducted by phone.
The landlord has applied for possession of the premises following the termination of the tenancy.
On 28 February 2025, the landlord gave the tenants 90 days’ notice under section 51 of the Residential Tenancies Act 1986. That section allows a landlord to end a tenancy for no reason. It does not mean that the tenants have breached any obligations under the Act.
Although the notice of hearing to the parties referred to other sections of the Act, the tenancy was terminated simply because the landlord gave 90 days’ notice, not for any other reason.
Under section 64, where any person is entitled to possession of the premises following the termination of a tenancy, the Tribunal must make an order granting possession of the premises to that person. That must be done within 90 days of the tenancy ending.
The tenancy ended on 30 May 2025. The application for a possession order was made on 28 July 2025, which was less than 90 days after the end of the tenancy.
The landlord has established that: a. The tenancy has terminated. b. The landlord is entitled to possession. c. The application was made within 90 days.
Therefore I must make an order granting the landlord possession.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee and there is an order for suppression of the landlord’s name and identifying details.
