The hearing took place at the Whangarei Courts on 19 September 2025. Both parties attended the hearing. Ms Kelly and Ms Knox represented the landlord.

The landlord’s rent record shows that the tenants made a large payment on 8 September 2025 that cleared all of the arrears at that time.

Ms Kelly and Ms Knox stated that the landlord is seeking termination of the tenancy on the grounds that the rent was more than 21-days in arrears on the date that the application was filed.

Section 55(1)(a) of the Residential Tenancies Act 1986 (“RTA”) states that the Tenancy Tribunal must make an order terminating a tenancy if the Tribunal is satisfied that the rent was more than 21-days in arrears on the date that the landlord’s application was filed.

This application was filed on 25 July 2025. The rent was more than 21-days in arrears on that date.

Section 55(1A) RTA states that the Tribunal may, instead of making a final termination order, make a conditional order, but only if it is satisfied that: a. The tenant will pay any arrears within a period specified by the Tribunal’ and b. It is unlikely that the tenant will commit any further breach.

Mr Lee explained the circumstances that led him into accruing substantial rent arrears. Mr Lee explained the changes that he and his wife have made to ensure that this never happens again.

I acknowledge the landlord’s concerns given the persistent rent arrears in this tenancy.

In the circumstances it is appropriate to make a conditional termination order to hold Mr Lee to his commitment to pay the rent in full and on time each and every week.

There is also a small balance of remaining arrears due to the fact that the rent week is Tuesday to Monday but the tenants usually pay their rent on a Friday. Mr Lee and Ms Chung undertook to pay that balance today.
