Initially, the landlord sought rent arrears, termination, refund of the bond, reimbursement of the filing fee, and name suppression.
Since the application, the tenant repaid the arrears, explaining her situation. Her efforts to resolve the arrears have been acknowledged as genuine and determined. Going forward
The landlord’s remaining concern was to prevent a similar future issue and to secure name suppression for the tenant, as no substantive issue required adjudication. The tenant is otherwise an excellent tenant.
The tenant’s arrears were largely due to circumstances beyond her control (an earlier bereavement resulting in change of situation, changes in WINZ entitlements that are still being re-assessed, moving to the property recently, whanau care, and cost of living) and partly due to a sincere misunderstanding about payment frequency at recently obtained work, which also impacted her WINZ entitlements. Despite this, she has worked hard to address the arrears independently.
The tenant now understands that her rent is payable weekly, while her income is received fortnightly, and so she is still currently exploring with WINZ what further assistance may be available to help meet her weekly rent obligations.
The landlord’s concerns are not unreasonable; and the tenant’s approach to resolving the matter remains commendable. Name suppression
Suppression of the names and identifying details of both parties is appropriate in the circumstances, having regard to the landlord’s support, the tenant’s personal situation, her genuine efforts to remedy the arrears, and the absence of any adverse finding that would warrant public identification. Filing fee
Although, by the time of the hearing, there was no longer a substantive claim to resolve due to the tenant’s repayment of the arrears, the filing of the application was a catalyst for that repayment.
