- The Bond Centre is to pay $2,409.75 from the bond of $3,200.00 ([Bond number suppressed]) to [The landlord/s] immediately being rent arrears to 29 September 2025.
- The balance of the bond is to remain at the Bond Centre until the end of the tenancy.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy on the basis of rent arrears. [The tenant/s] the tenant consents to the claim. Accordingly, I make an order terminating the tenancy on the date agreed by the parties.
What monetary amounts are owed?
- [The tenant/s] currently owes $1,200 in rent arrears. [The landlord/s] agrees to this amount being paid from the bond. Accordingly, I direct the Bond Centre to release $1,200 of the bond to the landlord to discharge the rent arrears. The remaining bond is to stay at the Bond Centre until the tenancy has ended and any other owing costs are clarified.
- [The tenant/s] also owes $210 for the water rates for August and September. She will pay this amount tonight.
- Because [The landlord/s] has substantially succeeded with the claim I have also reimbursed the filing fee.
- [The landlord/s] further applied for break lease costs. Because these costs have not yet been incurred and the actual amount owing is as yet unclear, he withdraws this claim to be reconsidered at the end of the tenancy. I note that, pursuant to section 44A of the Residential Tenancies Act 1986, (RTA) such costs must be itemised and reasonable before they can be sought from a tenant. I leave this to the parties to resolve at the end of the tenancy.
- Finally, because parts of this order are made by consent, pursuant to section 95A of the RTA, I approve suppression orders in both parties’ favour.
