Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the tenants’ and landlord’s name and identifying details.
[The landlord/s] must pay [The tenant/s] $28.00 immediately, being for reimbursement of the filing fee.
The Bond Centre is to pay the bond of $2,280.00 ([Bond number suppressed]) to [The tenant/s] immediately.

Reasons

Both parties attended the hearing.
The tenant has applied for refund of the bond. The landlord has a claim against the bond but has not filed a counterclaim with Tenancy Services.
Section 22B(2) Residential Tenancies Act 1986 (RTA) provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim.
The effect of this provision is that when the tenant applies to the Tribunal for release of the bond in whole or part, if the landlord wishes to argue that it has any call on the bond, then the landlord “must” file a counter claim for it. In the absence of a counter claim, the Tribunal must order that the bond be released to the tenant.
This means that if the landlord subsequently wishes to pursue any claim against the tenant, the landlord is still able to do so. However, if the landlord is successful in the claim, there would not be any bond that the Tribunal could order be released to go toward the landlord’s claim.
For these reasons and in the absence of a counter claim by the landlord, the Tribunal orders that the full bond be refunded to the tenants.
Because [The applicant/s] have wholly succeeded with the claim I must also reimburse the filing fee.
Both parties sought name suppression and in consideration of the interests of the parties and the public, suppression is appropriate in the circumstances. See section 95A of the RTA. R Harvey-Lane 17 October 2025
