Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- Dave Graham owes [The landlord/s] $5,580.00 (“the debt”) being rent arrears to 09/10/2025.
- Dave Graham must pay the applicant: a) $1800.00 on Thursday 9 October 2025 and on Thursday every week thereafter being $340.00 towards current rent and $1460.00 towards the debt in order 2. b) $660.00 on Thursday 16 October 2025 and on Thursday every week thereafter being $340.00 towards current rent and $320.00 towards the debt in order 2 until the debt is paid in full.
- Payments will be allocated to rent and then to rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 20 Wakelin Street, Carterton, Carterton 5713 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- The tenant wants to repay the debt to avoid immediate termination. The applicant accepted the tenants offer. The agreement is reflected in the orders above.
- The applicant advised that a 90 days’ notice has been issued and this order does not impact the effects of that notice.
- The applicant provided records showing the amount owing. I am satisfied these records are correct.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- Because [The applicant/s] has wholly succeeded with the claim I have reimbursed the filing fee and granted their request for suppression.
