The tenancy commenced on the 12 th of February this year.

Under section 51(1) of the Residential Tenancies Act 1986, a landlord is entitled to terminate a periodic tenancy by giving a 90-day notice without reason.

For completeness, I asked the applicant if there were any circumstances that might render the notice retaliatory under section 54 of the Act.

The applicant tells me that he believes the respondent was motivated by a complaint of his neighbour. He says that the complaint was not against him but rather against one of his guests at the tenancy address who had an altercation with the neighbour. He told me that the guest in question had an independent relationship with the neighbour which he characterised as exchanging messages online for a few weeks.

The respondent did not dispute that the neighbour’s complaint motivated the issue of the 90-day notice. They stated that the applicant is responsible for their guests conduct in the community. This is not correct but did not have any bearing on my decision.

For me to declare the notice to be of no effect under section 54 I would need to satisfy myself that the notice was motivated by the applicant’s exercise or proposed exercise of their right, power, authority, or a remedy available to them under the tenancy agreement or in law. This requirement is not met if the landlord is merely motivated by the conduct of the tenant. Rather the conduct that has motivated the notice must be encapsulated by the above criteria.

Because there are no grounds for me to set aside the notice or to declare it to be of no effect, I must dismiss the application.
