Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
- The tenancy of Sarah Mcgrath and Aden James Bergquist at 71 Gladstone Road, Dalmore, Dunedin 9010 is terminated, and possession is granted to [The landlord/s], at 11.59pm on Wednesday 24 September 2025.
- The Bond Centre is to pay the bond of $3,580.00 to [The landlord/s] immediately.
- Sarah Mcgrath and Aden James Bergquist must pay [The landlord/s] $6,155.14 immediately, calculated as shown in the table below:
Reasons
- Both parties attended the hearing – the landlord by video conference and the tenant by teleconference. Ms Mcgrath represented Mr Bergquist at today’s hearing.
- The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.
- Rent was at least 21 days in arrears on the date the application was filed and continues to be significantly in arrears. The tenancy is therefore terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- I note that the tenant advised that she was moving out tomorrow and so the termination date has been put at tomorrow’s date – 24 September 2025.
- The landlord provided rent records which proves that as at tomorrow’s date there is $9,707.14 owing in rent. The last payment of rent was $1,300.00 on 11 July 2025.
- Further to this I am ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful with the claim against them.
- For the same reason I am allowing the landlord’s application to have their name and identifying details suppressed. C ter Haar 23 September 2025
