The tenant has applied for a rehearing of the Tribunal order dated 9 September 2025 (the Order) as they missed the hearing due to confusion over time differences.

For the reasons set out below, I am satisfied that a miscarriage of justice may have occurred and a rehearing is granted. See section 105 Residential Tenancies Act 1986.

The tenant now lives in Brisbane and had made a counter-claim to the landlords claim for rent arrears. The counter-claim is reasonably detailed and it is apparent that the tenant had put work into his preparations.

On the day of the hearing the tenant had miscalculated the time difference between Wellington and Brisbane and so did not call in to the hearing. While an attempt was made to call his Australian number by the case manager, the number provided did not call through. When I tried that number today the same issue arose, although I was able to contact the tenant on his New Zealand cell number.

If a person is facing claims made against them it is a fundamental principle of natural justice that they are given the opportunity to present their response and to be heard. I am satisfied that there was a genuine error which led to the tenant being unavailable on the day. As such he has not had the opportunity to respond to the case made against him or to pursue his counter-claim. It would be unjust for the Order to stand, and I grant a rehearing.
