Order
- [The tenant/s] and [The tenant/s] must also pay Yellow Group Property Management Limited As Agent For Avinesh Prasad $1,960.00 on 24 September 2025, being rent arrears to 15 September 2025.
- [The tenant/s] and [The tenant/s] must pay Yellow Group Property Management Limited As Agent For Avinesh Prasad $560.00 on 17 September 2025, for current rent for the week of 16 September 2026 and continue paying weekly rent of $560.00 to the landlord every Tuesday onwards.
Reasons
- Both parties attended the hearing.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing to today of $2,040.00.
- While the current arrears are presently over 21 days in rent, the landlord has not made an application to terminate the tenancy under section 55(1) or 56 Residential Tenancies Act 1986 on the date that this application was filed on 14 August 2025. For that reason, I am unable to accede to the landlord’s request for immediate or conditional termination of the tenancy today.
- The tenant accept the rent arrears today but were unaware of the missing WINZ payments from one of them since 23 July 2025 until the hearing.
- Now that they are aware of the missing rent from Ms [The tenant/s]’s portion of the rent, the tenant promise to clear the arrears by seeing WINZ officers immediately and getting a lumpsum payment to the landlord.
- Under the circumstances, I make two sets of monetary orders.
- Firstly, for the tenant to start paying current weekly rent of $560.00 from tomorrow onwards. Secondly, for the tenant to clear the rent arrears next week.
- The tenant’s payment of $560.00 tomorrow will go towards weekly rent from 16 September 2025 (Tuesday) until 22 September 2025 (Monday).
- With the weekly rent being paid by the tenant moving forward, the rent arrears to be cleared by the tenant for arrears as at 15 September 2025 is $1,960.00.
- I make the above orders accordingly.
