Order
- [Tenant 1] agrees to the bond of $2,800 being transferred into the sole name of [Tenant 2].
- [Tenant 2] and [The landlord/s] are to make the arrangements with the Bond Centre for this change to be made.
- [Tenant 1] is to pay [The landlord/s] $74 immediately being $60 rent arrears and half the application fee ($14).
- [Tenant 2] is to pay [The landlord/s] $2,014 immediately being $2,000 rent arears and half the application fee ($14).
- [Tenant 2] is to pay [The landlord/s] $800 rent arrears at a rate of $100 per week for 8 weeks commencing this week.
- [The landlord/s] and [Tenant 2] agree to release [Tenant 1] from the tenancy conditional upon orders 2 and 3 being complied with. Following this order [Tenant 2] remains solely liable for the tenancy and all terms and conditions of the tenancy remain the same.
- [The landlord/s] agrees that for the next four weeks of the tenancy commencing with the rental week starting 15 October 2025, the rent for [Tenant 2] will reduce by $100 to $620 per week. From 12 November 2025 the rent will revert to $720 per week.
- [Tenant 1] is to remove all of his belongings by 26 October 2025, return the keys to [Tenant 2], and ensure that the room and bathroom he has been using are returned reasonably clean and tidy.
- If any of the payments by the tenants fail to be made within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
- Suppression orders are made in favour of all parties.
Reasons
- Both parties attended the hearing.
- Following the hearing the parties agreed between themselves to the following agreement which they have all consented to in writing: a. As at 14 October 2025, $2,860 in rent arrears is owing. b. The tenants are to reimburse the landlord the application fee. c. [Tenant 1] agrees to the bond being transferred solely into [Tenant 2]’s name in payment of the rent arrears. Both [The landlord/s] and [Tenant 2] are to contact the Bond Centre to have them record the change. d. [Tenant 2] is to pay the rent arrears in the following way: i. A payment of $2,000 to the landlord immediately. ii. Payments of $100 commencing on or before Monday 20 October 2025 and continuing on or before Mondays for eight weeks. e. [Tenant 2] will also pay the landlord $14 as a half share of the filing fee today. f. [Tenant 1] is to pay the following immediately: i. $60 towards the rent arrears. ii. $14 towards the filing fee. g. The landlord has agreed to reduce the rent by $100 per week for up to four weeks to assist [Tenant 2] in finding someone to take over [Tenant 1]’s share of the tenancy. After this four-week period, the rent will revert to $720 per week. h. [Tenant 1] must remove all of his belongings within 7 days from the date of this agreement, return the keys to [Tenant 2], and ensure that the room and bathroom he has been using are properly cleaned. i. [Tenant 2] will take over the tenancy agreement and the property in its current condition (“as is”) unless any issues are raised immediately. j. [The landlord/s] and [Tenant 2] agree to release [Tenant 1] from the tenancy conditional upon receiving the payments of $2,000 from [Tenant 2] and $60 from [Tenant 1]. k. The tenancy will continue solely in [Tenant 2]’s name with all other terms and conditions continuing.
- The parties have asked the Tribunal to confirm their agreement by way of consent order. All three parties have directly confirmed their consent to these specific agreements to the Tribunal. The order has been issued upon receipt of these consents.
- As this order is made by consent, I approve suppression orders in favour of both parties.
