Reasons

The landlord attended the hearing which was held by teleconference. The tenants did not answer the calls made at the scheduled time on the number provided to the Tribunal.

The tenants have been served by post to their residential address.

Because I am satisfied the tenant has been served notice of the hearing in accordance with the Residential Tenancies Act, 1986 and the tenant has not requested an adjournment, the hearing was conducted in the tenant’s absence.

The landlord applied for termination of the tenancy for failure to remedy a breach, and rent arrears.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to maintain the premises in a reasonably clean and tidy condition. Photographs provided by the landlord show a large amount of rubbish inside and outside the premises, and the premises to be in a very dirty condition.

On 28 July 2025 the landlord served a 14-day notice on the tenant to remedy the breach. On 15 August 2025, the landlord re-inspected the premises and nothing had changed; the tenant did not remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy because of the extent of the rubbish and dirtiness of the premises and because the tenant has made no effort to address the breach nor to engage with the landlord subsequently.

The landlord did not provide a rent summary. This meant the claim for rent arrears could not be pursued today. Because the landlord will be making another application to Tenancy Services regarding damages, I grant the landlord leave to also bring the claim for rent arrears at a later date.

Because [The landlord/s] has substantially succeeded with the claim I must reimburse the filing fee.
