The landlord has applied for termination of the tenancy for abandonment through the expedited process under section 91AA Residential Tenancies Act 1986.

Are there grounds for an expedited application?

I am satisfied that the two requirements for the expedited process are met: a. The tenant does not want to contest the abandonment application. b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 11 August 2025, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord said rent had fallen into arrears but they did not receive any response from the tenants to their correspondence, that they provided notice of an inspection visit and when they attended the property, they found the front door had been forced open and the property converted into a cannabis growing operation. The landlord said they found documents from the police inside the property, and provided copies of a police report dated 22 July 2025, indicating the police had executed a search warrant at the property due to information it was being used as a cannabis growing house. A copy of the search warrant was also provided. The landlord also provided a Property Condition Report with multiple photographs. The interior photographs showed large mounds of dirt around the property, hoses, pipes, sheeting on the floors, rigged electrical wires and other equipment, throughout the house. The police indicated in their letter that they had seized cannabis plants but left other equipment at the property. The landlord said they have not had any response from any of the tenants, despite multiple attempts to reach them. Copies of the landlord’s emails to the tenants were also provided. I am persuaded by this evidence that the tenancy has likely been abandoned.

The tenants have not contested the application.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.
