- By consent, [The tenant/s] and [The tenant/s] owes [The landlord/s] $411.00 (“the debt”).
- [The tenant/s] and [The tenant/s] must repay the debt as follows: a. By 10 fortnightly payments of $40.00. b. A final payment of $11.00.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates the balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- This was a fixed term tenancy until February 2026, ended early by the Tenant.
- The Tenant has advanced a case for hardship, but the Landlord acted quickly to replace the Tenant – within 4 weeks – and has incurred costs in the early termination and reletting ($411), which are not altogether unreasonable in my assessment.
- The parties have reached agreement on a total repayment amount and a repayment arrangement.
