Reasons

The landlord attended the hearing but the tenant did not appear. I am satisfied the tenant was given notice of the hearing and claim via an email address the tenant has provided to the landlord and therefore has had notice the termination application was being heard.

The landlord has applied for termination of the tenancy. The landlord’s evidence is that no rent has been paid since 2022.

Having reviewed the claim and the evidence after the hearing, I am satisfied from the landlord’s evidence that rent is more than 21 day’s in arrears at the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

Possession is granted to the landlord. The landlord said she is not sure who is living in the property. If the tenant does not vacate the property immediately the landlord is able to apply for an eviction warrant which will result in a bailiff carry out the eviction.

Any further claim by the landlord against occupants living in the property (other than the tenant), who are not removed as a result of an eviction warrant as above, will require the landlord to make a possession application to the Tenancy Tribunal which will need to be served on the occupants (by putting a hearing notice and copy of the claim on the door). The landlord has been successful in her claim and is granted suppression as requested. The Tribunal of its own initiative orders suppression of the tenant’s name. In doing so I have had regard to the interests of the parties and the public interest and do not consider there is nay public interest in having the tenant’s name published.
