Reasons
- [The property manager] attended the hearing on behalf of the landlord. A call to the tenant went unanswered.
- The landlord has applied for rent arrears, compensation for rubbish removal, cleaning and carpet cleaning as well as refund of the filing fee. The bond has already been paid to the landlord.
How much does the tenant owe?
- In an order dated 11 August 2025, in proceedings numbered 5316184, the Tribunal made an order under section 61 terminating the tenancy on the grounds of abandonment.
- The landlord provided rent records which prove the amount owing to 11 August 2025 was $3,045.56. Section 61(3) provides that in the case of a fixed-term tenancy, rent remains payable until the property is re-tenanted or to the end of the fixed-term, whichever is the sooner.
- [The property manager] advised that the new tenants moved in on 27 August 2025 and so Ms Parkinson owes rent up to and including 26 August. The amount ordered includes that rent.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40 of the Residential Tenancies Act 1986.
- [The property manager] provided invoices for rubbish removal, cleaning and carpet cleaning. The photos on file 5316184 show that the premises were not left reasonably clean and tidy and there was rubbish left behind. [The property manager] said that the carpets also required cleaning because they were stained and filthy.
- The amounts ordered are proved.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
