On 1 June 2025, [The landlord/s] sent Ms Niland a text message stating: After many conversations over months about late rent payments and unpaid rent, I am terminating the tenancy agreement and giving you 90 days notice as of today. As discussed.
Ms Niland replied: Agree to 90 days and will do my best as always
[The landlord/s]’ application sought a possession order.
[The landlord/s] amended the application to include a claim for rent arrears.
The hearing took place by video conference at 9,30am on 8 September 2025.
At 8.20am on 8 September, the Registrar received an email with PDF submissions attached, apparently relating to this application but sent by a person identifying themselves as Maria W A Doevendans. This email was forwarded to me at 9.22am.
The email states: Sorry I don’t know how to login for hearing at 9.30 today. PLS send link. PLS also send attached to judge in case anything goes wrong.
I attempted to call Ms Niland by phone at the start of the hearing. The call went to voice mail.
[The landlord/s] participated in the video hearing.
The Tenancy Tribunal may hear and determine a matter in the absence of one of the parties if the Tribunal is satisfied that the person received notice of the hearing. 1 I proceeded with the hearing in Ms Niland’s absence on the grounds that: a. Ms Niland received notice of the hearing. It was sent to her on 1 September 2025. b. The notice of hearing has the link to attend the video hearing. c. The notice of hearing states: “If you are unable to take part via Microsoft Teams – the adjudicator will call you on the phone number provided in the application”. d. The notice includes an email address to communicate with the Tribunal. e. A person who may or may not be Ms Niland waited until one hour before the hearing to contact the Tribunal regarding difficulties with linking into the hearing. Termination and possession
Although [the landlord/s] and Ms Niland entered into a Flat/House Sharing Agreement in 2020, [the landlord/s] clarified that the premises that Ms Niland occupied are separate and self-contained.
This was a standard residential tenancy, and the Residential Tenancies Act 1986 (“RTA”) applied to it. 1 Section 92(1) Residential Tenancies Act 1986 (“RTA”)
A landlord may terminate a periodic tenancy “in any case” by giving the tenant at least 90-days’ notice in writing. 2
The Tenancy Tribunal has no power to set aside or refuse to uphold a formally valid 90-day notice unless the notice is discriminatory 3 or retaliatory 4 .
In this instance: a. [The landlord/s] sent the termination notice in writing. b. [The landlord/s] sent the notice via the usual means of communication between the landlord and tenant. c. Ms Niland acknowledged receipt of the notice. d. There is no evidence to indicate that the reason for the notice was discriminatory or retaliatory.
The Tribunal must make an order for possession on application by anyone entitled to the premises following termination of the tenancy. I am satisfied that: a. The tenancy has terminated pursuant to the 1 June notice. b. [The landlord/s] is entitled to possession of the premises.
I have made a possession order accordingly. Rent arrears, bond, name suppression
[The landlord/s] did not provide a rent record. A rent record is an essential document in any claim for rent arrears.
[The landlord/s] will send provide the rent record to the Tribunal by email. I will then make a further order in respect of the landlord’s claim for rent arrears.
