- The tenancy of [The tenant/s] tenant/s] and [The tenant/s] tenant/s] at 25 Reservoir Road, Oamaru North, Oamaru 9400 is terminated, and possession is granted to Robertson Property Management Limited T/A: L J Hooker Oamaru Rentals As Agent For Stephen Robertson, at 11.59pm on Tuesday the 21 October 2025.
- The Bond Centre is to pay the bond of $1,488.72 (5843149-004) to Robertson Property Management Limited T/A: L J Hooker Oamaru Rentals As Agent For Stephen Robertson immediately.
- The balance of the bond of $71.28 is to be held at the Bond Centre.
Reasons
- The landlord attended today’s hearing. The tenants were called twice on the phone numbers in the application, but all calls went to answerphone. I am satisfied that the tenants were notified of today’s hearing and have proceeded in their absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed on 29 August 2025. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records (ledger) which prove the amount owing at the end of the tenancy. I note that the tenant is still more than 21 days in arrears at today’s date.
- Because Robertson Property Management Limited T/A: L J Hooker Oamaru Rentals As Agent For Stephen Robertson has wholly succeeded with the claim I must reimburse the filing fee.
