Mr Liu provided a rent summary and water records which prove the amounts owing to on the balance of probabilities. The tenants questioned Mr Liu’s rent calculation, but they have had months to obtain evidence that his calculations are in error.

Mr Liu is an experienced property manager. His calculation of rent due was correct. It is unlikely he could not accurately add up the rent that was received. It is a simple matter of adding up the amounts received, which are then subtracted from the rent due to calculate the balance. The tenants on the other hand, were not well organised. They had not calculated the amount of rent they had paid nor the rent that was due. I found the tenants’ submissions unpersuasive.

I find the arrears proven, as set out in the table above.

The Bond Centre is to pay the bond out the landlord in part payment of the tenants’ debt under this order.

The tenants say they can pay what they owe at the rate of $100.00 per week. An order is made accordingly. If they miss a payment, the landlord may sue for the outstanding balance immediately.
