A hearing scheduled for 2 October 2025 was adjourned at the tenant’s request.

Today’s hearing was scheduled for 9:30am. On 6 October the tenant requested an adjournment of today’s hearing on the grounds that he had an optometrist’s appointment at 8:00am. To accommodate that appointment, the hearing was stood down to 3:30pm and the parties were advised.

Several attempts were made to contact the tenant on the number given in the Notice of Hearing and also on the number noted in his recent adjournment request. All calls went to answerphone.

I determined that the hearing should proceed.

The landlord seeks termination of the tenancy under s.55(1)(c), which requires the Tribunal to terminate a tenancy where it is satisfied that the tenant has threatened to assault a neighbour.

In the Tribunal, proof is required on the balance of probabilities (more likely than not) rather than beyond reasonable doubt but where there are serious allegations such as these, there needs to be a solid evidential basis for the claims.

Her evidence, which I have no reason to disbelieve, is that in her presence, the tenant said that: a. he would make sure the neighbour left in a box; and b. twice stated that he would break into the neighbour’s home and bash him to death.

The evidence satisfies me that what was said and the manner and context in which it was said, justified the neighbour and keyworker taking it seriously.

As a consequence, the neighbour has been relocated and the upstairs flat is empty.

I find it proved on balance that the tenant threated to assault his neighbour. The tenancy must be ended.

The landlord agrees that the termination date should be in 21 days’ time to enable other accommodation to be arranged.
