Both parties attended the hearing. The tenant filed an application on 21 August 2025 seeking compensation and a rent reduction after the property she was renting was flooded.
The landlord filed a cross application on 4 September 2025 seeking termination and rent arrears.
Since the filing of the applications the situation has changed somewhat. The tenant is still at the property but has been served a 90 day notice to terminate the tenancy. The end date for the tenancy is 4 June 2026. The bond is to remain at the bond centre until the end of the tenancy.
The landlord is therefore not seeking termination, just rent arrears, filing fee and suppression of their name.
The tenant is seeking a rent reduction, compensation for power bills, dog day care costs, filing fee and suppression of her name. Background
The tenant experienced a flood in the rental property, resulting in significant disruption for a period of 16 weeks. During this time, the internal walls were cut out up to 600 mm, insulation was removed, carpets were lifted, and industrial dryers were operating for 9 days. Tradespeople were present in the property throughout the 16-week period, and the tenant was unable to use approximately 60% of the house. The weekly rent for the property is $995.00. The landlord has offered a rent reduction of $150.00 per week. Loss of Amenity – rent reduction:
The Tribunal finds that the tenant was deprived of the use and enjoyment of a substantial portion of the property for a prolonged period. The disruption caused by ongoing repairs, loss of insulation, and the presence of tradespeople significantly diminished the tenant’s living conditions. Calculation of Rent Reduction
Where a tenant loses access to a significant part of the premises, the rent should be reduced proportionately to reflect the actual loss of use. In this case, the tenant was unable to use approximately 60% of the house for 16 weeks. -Weekly rent: $995.00 -Proportion of house lost: 60% -Rent reduction per week: $995.00 x 60% = $597.00 -Rent payable per week during repairs: $995.00 - $597.00 = $398.00 -Total rent reduction owed $597.00 for 16 weeks is = $9552.00
Total additional compensation for rent reduction is $9552.00 Power bills:
The tenant claimed that her average monthly power bill over the time she had been in the property before the flood was $270.00 per month. After the flood, the tradespeople were using the power in the property to carry out repairs and there was an industrial dryer running for 9 days.
The tenant claimed that over the time the work was being carried out her power bills were $610.00, $417.00 and $375.00, which totals $1402.00.
The tenant would have paid $810.00 during this time had there not been the flood.
I consider it fair and reasonable that the tenant receives compensation to cover the difference that she would have paid had it not been for the flood and the actual amount she did pay. The difference is $600.00, and I find that is reasonable to cover the increased power bills during the 16 weeks.
The total compensation for the power bills is $600.00 Dog day care bills:
The tenant has a dog at the property. The dog was unable to stay at home during the day when the tradespeople were repairing the property. The tradespeople would leave the door open and there were safety concerns having the dog in that space during this time.
The tenant incurred dog day care bills of $3083.98 during the period of 6 June 2025 to 26 September 2025 and seeks some compensation for these costs. The tenant states that she would only take the dog to day care once a week rather than full time as was required during the 16 week period. The tenant would have spent $880.00 on day care fees rather than $3083.98. Deducting $880.00 from $3083.98 extra in day care fees, is $2203.98. These fees are a direct result of the flood and 16 week period where the property was being repaired.
The Tribunal is satisfied that these costs were reasonably incurred due to the disruption and loss of amenity caused by the repairs. The landlord is ordered to
The landlord is ordered to pay the tenant an additional $1100.00 as compensation for loss of amenity during the 16-week repair period, in addition to any rent reduction already provided. Landlord claim:

The landlord provided rent records which prove the amount of $11,514.00 owing in rent arrears to 20 March 2026.
The tenant does not dispute the rent arrears.
I am satisfied that the landlord has been successful in their claim for rent arrears.
The Tribunal must deduct the compensation and rent reduction from the rent arrears. The tenant must pay the landlord the sum of $862.00 for rent arrears to 20 March 2026.
Both parties are seeking reimbursement of their filing fees. However as both have been successful, I am not awarding the filing fees to either.
Both parties seek suppression of their name and details and as they have been successful, I will grant suppression to the landlord and tenant.
