Order
- [The tenant/s] must pay Crockers Property Management Limited As Agent For Yan Zhen And [The landlord/s] $1,028.00 on or before Sunday 9 November 2025, being rent arrears to 30 October 2025 and reimbursement of the filing fee.
- [The tenant/s] must pay Crockers Property Management Limited As Agent For Yan Zhen And [The landlord/s] $800 today, Friday 31 October 2025 being the remainder of the rent for the week commencing today.
- [The tenant/s] must continue to pay Crockers Property Management Limited As Agent For Yan Zhen And [The landlord/s] the weekly rent of $1,150 on or before Fridays in accordance with the tenancy agreement.
- If [The tenant/s] fails to make any payment as recorded in orders 1 and 2 within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
Reasons
- Both parties attended the hearing. Ms Zhang represented the landlord.
- The landlord has applied for rent arrears and confirmation that the rent will be paid in accordance with the tenancy agreement going forward. Other claims were submitted in the application but amended at the hearing.
- It is agreed that up until yesterday, 30 October, Mr Marchant is $1000 in rent arrears. He says he will pay this debt on or before Sunday week being 9 November. Ms Zhang agrees with this date.
- Mr Marchant’s rental week commences on a Friday. He has paid $350 to the current rental week which started today. He agrees to pay the remaining $800 today.
- Mr Marchant confirms that he will pay his rent in accordance with his tenancy agreement going forward, that is on or before Fridays when the payment becomes due.
- Because Crockers Property Management Limited As Agent For Yan Zhen And [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
- Finally I note that during the hearing Mr Marchant advised Ms Zhang that there is a leak in the property. She is to contact him to obtain further details as he left prior to the end of the hearing.
