Order

Reasons
- The landlord’s representative attended the hearing by videoconference today. I telephoned the tenants. One number is disconnected and the other went to voicemail. I continued with the hearing as the tenants have been emailed notice of the hearing date and time to their addresses for service.
- The landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- On 23 April 2025, a Tribunal order was made by agreement between the parties relating to this tenancy, for a total of $4,867.00. This was rent arrears to 22 April 2025 of $4,840.00 and the filing fee of $27.00.
- The previous order set out certain repayment dates and that if these were not complied with the tenancy would terminate immediately. This is called a conditional termination order.
- The landlord says the tenants did not comply with the conditional termination order. The landlord asked them to vacate, and the tenants did so on 30 May 2025.
- The landlord now seeks payment of outstanding rent up to 30 May 2025.
- The rent ledger provided today proves that:- a. The tenants made total payments towards the first conditional termination order of $4,280.00; b. Total rent owing from after the first order until the end of the tenancy is $3,148.57 (from 23/04/2025 – 30/05/2025).
- I now award the filing fee on this application of $28.00.
- The result of the above amounts owing and paid is that the tenants owe a total of $3,763.57 up to the end of the tenancy. Bond, balance to pay, and suppression of name
- I refund the bond of $1,920.00 to the landlord.
- The balance left to pay by the tenants is $1,843.57. They may be able to make a repayment plan with the landlord to avoid collection costs.
- The previous order 5185792 is incorporated into this order for enforcement purposes. If the tenants do not repay the amount owing, the landlord can enforce this order.
