- An application for suppression has been made in this case, and the Tribunal orders suppression of both parties’ names and identifying details.

- The tenants may by agreement pay $300 per week towards their rental obligations for the remaining weeks of the tenancy commencing tomorrow, 29 October 2025.
- The rent shortfall and other amounts owing may, by agreement, be taken from the bond at the end of the tenancy.
- If there is any amount outstanding over and above the bond, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
Reasons
- Both parties attended the hearing. Mr Banerjee represented the landlord.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- As the rent was at least 21 days in arrears on the date the application was filed, the tenancy must be terminated. See section 55(1)(a) Residential Tenancies Act 1986. The date of termination is agreed between the parties.
- It is also agreed that as the tenants cannot afford the full rent at this time, they may pay $300 weekly towards the rent commencing tomorrow. The shortfall ($150 per week) may be taken from the bond at the end of the tenancy.
- The other amounts owing, being the previous rent arrears and water rates arrears and filing fee, may also be taken from the bond when the tenancy ends. Any amount owing over and above the bond will be enforceable as a monetary order.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
- Because this order is made by consent it is appropriate that all identifying details of the parties be suppressed from the published order.
