Order
- [The tenant/s] must pay Hoverd & Co Property Management Ltd As Agent For Blair Knight And [The landlord/s] $868.00 immediately, being $840.00 rent arrears to 19 November 2025 and the filing fee of $28.00.
Reasons
- Only the landlord attended the hearing. The tenant was phoned twice the call was not answered.
- The landlord has applied for termination, the filing fee and rent arrears.
Should the tenancy be terminated?
- The landlord issued a 14 day notice to the tenant on 22 September requiring the tenant to pay arrears of $1,290.00 by 6 October. The rent record shows that rent and additional part payments of rent were made after that date but by 6 October the rent was still $1,013.57 in arrears.
- As at the date of the hearing, 19 November the rent is $840.00 in arrears.
- The tenant is in breach of the tenancy agreement to pay rent in advance. The tenant failed to pay arrears of rent that was required by the 14 day notice. The tenancy could be terminated.
- However having considered the evidence regarding rent payments and the amount of the arrears, I am not satisfied that the breach is of such a nature or of such an extent that it would be equitable make an order terminating the tenancy. Rent payments are from overseas by bulk payments and the amount of arrears at the time of the hearing is considerably less than the bond.
- The tenant should be aware however that ongoing rent arrears could lead to termination if the landlord made an application in the future. Filing fee
- Because the landlord has been successful with the claim the filing fee of $28.00 is ordered to be paid by the tenant.
