Order
- The Tribunal orders suppression of the parties’ names and identifying details.
- In settlement of all claims either party may have against the other arising from the tenancy, the parties have agreed to divide the bond of $1,800.00 equally between them.
- The Bond Centre is to divide the bond of $1,800.00 equally between the landlord and the tenant so that each party receives $900.00.
- [The landlord/s] must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
- The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.
Reasons
- Both parties attended the hearing by telephone.
- The tenant explained that he understood that the parties had agreed that the tenancy would end on 12 October 2025 and that the bond would be divided equally between them. He advised that it was on this basis that he withdrew his application against the landlord. He confirmed his agreement that if the landlord agreed to these terms, he would not make any claims against the landlord.
- The landlord explained that she had found further costs for which she would be seeking compensation once the tenant had moved out. She had rejected the tenant’s offer because it required immediate payment by the landlord, not an equal payment from the bond which usually takes a few days. She explained that she was seeking the full bond in compensation and for rent arrears.
- The tenant withdrew from the telephone hearing.
- The landlord then read through the email from the tenant offering settlement on the terms in paragraph 2 and confirming that the landlord could dispose of any items which he had left at the property.
- The landlord then agreed to the tenant’s proposal that they share the bond in settlement of all claims by either party arising out of the tenancy.
- I am satisfied that the tenant confirmed his acceptance of the settlement contained in this order and has consented to the landlord disposing of his goods remaining at the property. It is appropriate that the parties’ agreement be recorded in this Consent Order.
- As the parties reached agreement by consent at the hearing and there are no matters of public interest in this order, it is appropriate that this order not be published so that the parties’ names and the terms of their agreement are kept private and out of the public domain.
