- [The tenant/s] and [The tenant/s] must pay Bayleys Real Estate Limited As Agent For Andrea Pirie $2,811.99 immediately, being rent arrears of $2,533.86, water rates of $250.13 and reimbursement of the filing fee of $28.00.
Reasons
- The landlord attended the video hearing.
- The landlord has applied for rent arrears and water rates.
- The landlord provided rent records which prove the amount owing.
- The tenant had accepted in an email to the Tribunal that the water rates were owing to the landlord.
- In that email, the tenant claimed that further payments had been made to the landlord which were not showing in the rent statement and that the landlord had agreed to reimburse the tenant for a rangehood that the tenant purchased for the property. She claimed that these sums should be offset against the rent owing.
- The landlord provided a statement which showed that the additional payments were credited to water rates on 24 October 2024, January 2025 and February 2025.
- The statement also showed that $699.00 was received from the owner and credited to the tenant’s rent account on 4 April 2025. This credit is also showing in the landlord’s rent statement which was supplied to the tenant with the landlord’s application.
- The Tribunal is satisfied that all payments made by the tenant have been received by the landlord and credited to the tenant and that the tenant has been reimbursed for the rangehood.
- The landlord’s claim is proven.
- Because Bayleys Real Estate Limited As Agent For Andrea Pirie has wholly succeeded with the claim I must reimburse the filing fee.
