Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord name and identifying details.
[The landlord/s] must pay [The tenant/s] $450.00 immediately.
By consent [The tenant/s] may end the tenancy early by giving the landlord 7 days written notice.
The landlord must carry out the following work to the premises, which must be completed by 5pm on Wednesday 17 December 2025 a. Either repair or replace the element on the stove that is not working.

Reasons

Five tenants and the landlord all attended the hearing.
The tenants sought compensation and exemplary damages for the landlord’s failure to maintain the premises and work orders.
The tenancy is for a fixed term from 1/1/2025 to 31/12/2025 at $1,075.00 rent per week.
Under section 45(1)(a) - (ca) Residential Tenancies Act 1986, the landlord has an obligation to provide and maintain certain standards and to comply with applicable requirements.
Where the Tribunal finds the landlord has failed to comply with any of these obligations, it may make an order for the landlord to carry out the work. See section 78(1)(e) Residential Tenancies Act 1986.
After hearing the evidence both parties reached agreement about what work still needed to be completed, compensation for damaged possessions and early ending of the tenancy.
Orders are made to reflect the agreement reached in full settlement of the claim.
Suppression is granted to both parties pursuant to section 95A(4) because the parties reached an agreed settlement, and I consider it is in their interests to grant name suppression.
