Order
- [The tenant/s] owes Dragon Rentals Limited $748.00 (“the debt”) being $720 rent arrears to 24 November 2025 and $28 filing fee.
- [The tenant/s] must pay the debt in full today, 21 November 2025.
- Payments will be allocated in the following order: rent arrears and the filing fee.
- If the tenant fails to pay the rent arrears today: a. The tenancy at 44 Hadlow Terrace, Grey Lynn, Auckland 1021 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee today, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing by telephone.
- The landlord has applied for termination of the tenancy, rent arrears and payment of the bond. The parties have agreed that the tenant can repay the debt to avoid immediate termination.
- Where rent is at least 21 days in arrears on the date the application was filed, as it was in this case, the Tribunal must make either a final or a conditional termination order.
- The parties have agreed the terms of this order and so I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach.
