Reasons
- The hearing was conducted remotely on Microsoft Teams.
- Charles Yonardy attended the hearing for the landlord.
- The tenant did not attend. The hearing proceeded in their absence.
- The landlord has applied for rent and power arrears, compensation, reimbursement of the filing fee, and payment over of the bond following the end of the tenancy.
How much is owed for rent and power?
- The tenancy ended on 20 November 2025. The landlord provided a rent summary and power invoices (including a final pro-rata calculation for the final month) that prove the amount owing at the end of the tenancy for rent and power.
Did the tenant comply with their obligations at the end of the tenancy?
- The landlord added a late claim for cleaning. Mr Lopes provided photographs showing the condition of the unit at the end of the tenancy and an invoice for cleaning in the sum of $356.50.
- I proceeded to hear the claim for the sake of efficiency. Otherwise, another hearing would have to be convened at which it is likely the tenant would not appear again.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 1
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
- The condition of the unit was below the required standard but not greatly below.
- I consider that $270.00 is a reasonable reflection of the cost to bring the unit up to the standard. Therefore, I order this lesser amount. Filing fee
- The tenant must reimburse the landlord for the filing fee. 1 See s 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986. Bond
- The Bond Centre is to release the bond to the landlord in part payment of what the tenant owes the landlord for its costs incurred due to the tenant’s breaches.
