Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord name and identifying details.
[The landlord/s] is granted possession of the boarding house room and all facilities of the boarding house at [Tenancy address suppressed] at 5pm on Monday 3 November 2025.

Reasons

Both parties attended the hearing, by telephone.
The tenancy began on 20/10/2022.
On 7/10/2025 the landlord gave the tenant 48 hours notice to terminate pursuant to section 66U(2)(b).
The original termination date was 9/10/2025 which the landlord agreed to extend until 13/10/2025.
As the tenant had not vacated the premises by 13/10/2025 the landlord applied for possession.
Although the tenant disputed the basis for the termination notice he advised that he had started to pack his possessions but needed a bit more time to move.
After further discussions and discovering that the notice had been given under the wrong subsection of section 66U, the landlord agreed to extend the time for the tenant to move out.
A possession order has been made with the consent of both parties.
No filing fee is awarded to the landlord because I do not consider it reasonable to do so in the circumstances.
Suppression is granted pursuant to section 95A(4) because it is in the interests of both parties to do so, they having reached an agreement.
